25 Year Steel Frame Warranty Plus

Welcome to the King Living Warranty Plus program which has been designed to ensure you are provided with the best possible protection for your new furniture. Unlike ordinary furniture, King Living furniture is manufactured without staples. The removable cover system enables for the easier replacement of components allowing King Living furniture to outlast and out perform ordinary furniture. Our aim is to ensure your furniture stays looking great into the future, and in the unlikely event a problem may arise, it will be dealt with appropriately and with a minimum of inconvenience to you. 

THE WARRANTY

The following only applies if you are a consumer acquiring the product for personal, household use or consumption and may not apply in your particular case. In telling you the following, we do not vary or extend the remedies otherwise available to you. Our goods come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993 (“CGA”). Under the CGA, the remedy that you are entitled to will depend on the nature of the failure. You are entitled to a replacement or refund or damages in compensation for any reduction of value of the goods below the price paid or payable, for failure of a substantial character and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a failure of a substantial character. 

ADDITIONAL WARRANTIES 

Under this additional warranty, we choose whether to repair or replace, and that is the limit of our liability under this additional warranty. This additional warranty does not cover any damage caused by the use of other than genuine manufacturer’s parts and consumables. Note: for any item that is not actually manufactured by us, we will only provide that repair or replacement service to the extent that we can obtain the manufacturer’s approval to do so on their behalf, otherwise we will not offer that repair or replacement warranty for such an item. Purchases of indoor products manufactured by King Living after the 1st January 2015 will be covered against component failure for a period of up to 25 years from the date of purchase under the following terms and conditions: 

 1. The steel or alloy frame used in each piece of King Living furniture is warranted against failure due to a manufacturing fault for a period of up to 25 years from the date of purchase. 

 2. Other components including, King Leathers, King Fabrics, foam, feather and fibre fillings, suspension, springs, mechanisms including sofa bed mechanisms, zippers, touch fasteners and legs (but excluding electric and motion components) are warranted against failure due to a manufacturing defect for a period of 15 years from the date of purchase according to the Pro Rata Schedule* provided in this brochure. 

 3. Electric and motion components for all King Living furniture are warranted against failure due to a manufacturing defect for a period of 2 years from the date of purchase. 

 4. Accessories manufactured by King Living (excluding electrical accessories) are warranted against failure due to a manufacturing defect for a period of 2 years. 

 5. Electrical accessories manufactured by King Living are warranted against failure due to a manufacturing defect for a period of 12 months. 

 6. Fabrics, leathers, suspension components, cushioning and fillings will show signs of wear and tear with use. Normal wear and tear is not covered by this additional warranty. Fabrics and leathers will fade and crease. Foam and fillings will soften and form to the shape of the user over time. Depending on the covering and the degree of use, the covering materials, cushion fillings and suspension may need to be replaced periodically at the purchaser’s expense. Scars, marks and differing pore density and colour are natural characteristics of leather and are not to be considered defects. 

 7. Any repair or replacement under this warranty is limited to the defective part of the product only. Freight, house calls, labour and other items are charged to the purchaser at standard King Living rates and are not covered by this warranty. Covering components replaced under this additional warranty may vary in colour and texture to the original. 

 8. King Living reserves the right to decide in its sole discretion whether a component should be repaired or replaced. 

 How to claim under this warranty: 

To benefit under this additional warranty, the purchaser must forward to King Living a properly completed warranty registration card supplied within 14 days of purchase.  King Living Customer Service must be notified in writing of any defect within 14 days of the defect occurring at – King Living New Zealand Limited, company number 5542267.

This additional warranty will end immediately if the furniture becomes defective as a consequence of misuse, use outdoors, lack of proper care and maintenance, commercial use or handling in transit.

*Percentage of retail replacement cost. e.g. Replacement of a defective $100 part during year 3 would cost $25. House calls and transport costs are charged to the purchaser at Standard King Living rates which may be amended by King Living from time to time. This additional warranty applies to the original purchaser only who may not assign or transfer any benefit conferred by this warranty. 

Disclaimer of all other warranties and obligations:  

The CGA, the Fair Trading Act 1986 ("FTA") and other statutes may impose warranties, conditions and obligations on King Living which cannot by law (or which can only to a limited extent by law) be excluded.  Other than as expressly provided by this warranty and except as provided for under the CGA or the FTA, to the extent permitted by law, King Living excludes all such imposed warranties, conditions or obligations and exclude any warranty, condition or obligation imposed by law, equity or otherwise. 

Where the purchaser acquires the goods from King Living for the purposes of a business: 

(a) the parties acknowledge and agree that:

          (i) the purchaser is acquiring the goods covered by this guarantee for the purposes of a business in terms of sections 2 and 43(2) of the CGA;  

          (ii) the goods are both supplied and acquired in trade for the purposes of the FTA and the parties agree to contract out of sections 9 (Misleading and deceptive conduct generally), 12A (Unsubstantiated representations) and 13 (False and misleading representations); and 

(b) the purchaser agrees that all warranties, conditions and other terms implied by the CGA or sections 9, 12A and 13 of the FTA or any other statute or common law are excluded from these terms to the fullest extent permitted by law and that such exclusion is fair and reasonable.


10 Year Steel Frame Outdoor Warranty Plus

Unlike ordinary furniture, King Living furniture is manufactured without staples. The removable cover system enables for the easier replacement of components allowing King Living furniture to outlast and out perform ordinary furniture. Our aim is to ensure your furniture stays looking great into the future, and, in the unlikely event a problem may arise, it will be dealt with appropriately and with a minimum of inconvenience to you.

THE WARRANTY

The following only applies if you are a consumer acquiring the product for personal, household use or consumption and may not apply in your particular case. In telling you the following, we do not vary or extend the remedies otherwise available to you. Our goods come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993 ("CGA"). Purchases of outdoor products manufactured by King Living after the first of January 2012 will be covered against component failure for a period of up to 10 years from the date of purchase under the following terms and conditions:

• The steel or alloy frame used in each piece of outdoor King Living is warranted against failure due to a manufacturing fault for a period of up to 10 years from the date of purchase.

• Other components including, King Leathers, King Fabrics, KingWeave, foam, feather and fibre fillings, suspension, springs, mechanisms including sofa bed mechanisms, zippers, touch fasteners, legs and outdoor accessories are warranted against failure due to a manufacturing defect for a period of two years from the date of purchase.

•Fabrics, leathers, suspension components, cushioning and fillings will show signs of wear and tear with use. Normal wear and tear is not covered by this additional warranty. Fabrics and leathers will fade and crease. Foam and fillings will soften and form to the shape of the user over time. Depending on the covering and the degree of use, the covering materials, cushion fillings and suspension may need to be replaced periodically at the purchaser’s expense. Scars, marks and differing pore density and colour are natural characteristics of leather and are not to be considered defects.

• Any repair or replacement under this warranty is limited to the defective part of the product only. King Living Extended Warranty

King Living furniture may contain recliner electric and motion components.  Such recliner electric and motion components ("Product") will receive warranty coverage from King Living's manufacturer warranty applicable to that Product.  You can also obtain additional benefits by purchasing the optional King Living Extended Warranty.

Should your King Living Product be defective, you may choose to make a claim under the New Zealand Consumer Guarantees Act 1993 ("Consumer Guarantees Act"), the applicable King Living manufacturer's warranty or the optional King Living Extended Warranty (whichever is applicable).

Set out below is a summary of the features and benefits of the Consumer Guarantees Act, the King Living manufacturer warranty and the optional King Living Extended Warranty.

3 Year Extended Warranty

The two year King Living Manufacturer's warranty against failure due to a manufacturing fault of the Product can be extended for eligible customers for an additional three years (thereby totalling five years) for $            per recliner module/seat ("Extended Warranty") provided that:

1.the customer delivery address is in the metropolitan area of cities with a King Living Showroom (within 50km of a King Living showroom) ("Eligible Customer Address"); and

2.that the Product remains at the Eligible Customer Address for the Extended Warranty period.  If the Product is removed from the Eligible Customer Address the Extended Warranty will be void.  Please check with our staff to confirm that your address is an Eligible Customer Address for the Extended Warranty.

If a failure occurs during the Extended Warranty period, you should cease using the Product and contact King Living Customer Service (0800-546422 (0800-KINGCARE)) immediately with details of the failure.  We will then make arrangements with you to repair or replace your Product.

Your Rights under the Consumer Guarantees Act

If you are a consumer acquiring the Product for personal, household use or consumption, your rights and remedies under the King Living extended warranty are in addition to your rights under the Consumer Guarantees Act (if applicable) and the King Living manufacturer's warranty.  Under the Consumer Guarantees Act Products must:

(a) be of acceptable quality; 

(b) be reasonably fit for the purpose represented;

(c) match the descriptions supplied in the sample or demonstrator model;

(d) be delivered at a time or within a period agreed; and

(e) have clear title and no undisclosed security interests over the goods.

In addition, your manufacturer's warranty will be enforceable under law.  

Under the Consumer Guarantees Act, the remedy a consumer is entitled to if a Product fails will depend on whether the failure to comply with the guarantee is serious or minor and whether or not the fault can be fixed.  Minor failures to comply with the guarantee can normally be fixed or resolved within a reasonable period of time.  In this case the seller of the Product can choose to offer the consumer a refund, replacement or repair.  If the seller does not remedy the fault or takes too long to remedy it the consumer may be able to elect to have the fault fixed by a third party and can recover the cost from doing so from the seller (subject to certain conditions).  Where there has been a serious failure to comply with the guarantees, the consumer can elect to either:

(a) return the Product and receive a refund;

(b) return the Product and request replacement with an identical product or one of similar value if reasonably available; or

(c) retain the Product and receive compensation for the decrease in value as a result of the fault.  

Note that where you are acquiring the Product for business purposes the Consumer Guarantees Act does not apply and the information regarding the Consumer Guarantees Act set out in this document will not be relevant.

Your Right to Cancel

We offer a "cooling off" period for King Living Extended Warranties purchased.  This means that if within five working days of the date you entered into the King Living terms and conditions (by completing the King Living Extended Warranty registration form), you can cancel the King Living Extended Warranty purchased.  You will receive a full refund of the purchase price of the King Living Extended Warranty if you notify King Living in writing that you wish to cancel the King Living Extended Warranty within five working days.
